This page is important for you if you have received a notification that a complaint has been filed against one or more of the domain registrations you have applied for. In this case, you will find the relevant information below and can present a defence as to the merit by completing the form below.
Anyone who has a legitimate interest in establishing that the registration of a conditionally registered domain for a given domain applicant is in breach of the Domain Registration Policy may initiate the procedure of the Alternative Dispute Resolution Forum (Procedure of the Domain Decision Maker), which provides out-of-court dispute resolution services.
If you have a complaint about a domain name you have conditionally registered, you have the following options:
- If you do not contest the complaint, you have the right to withdraw your application for the domain name in question within 8 calendar days of the notification, in which case the domain name will be deleted.
- If you do not wish to withdraw from the application, you must pay the procedural fee within 8 days of the date of service of the complaint and you have the same deadline to present a defence as to the merit to the complaint by completing the form below, together with the relevant documents.
The procedural fee for a single domain is HUF 190,500 (HUF 150,000 + VAT). For those who have not had a lost procedure of the Domain Decision Maker since 1 January 2023, the procedural fee is HUF 76,200 (HUF 60.000 + VAT) per domain. Further discounts are available depending on the number of domains included in the procedure, so for the 2nd to 10th domains a 50% discount is available (i.e. the procedural fee is HUF 95,250 (HUF 75,000 + VAT) or HUF 44,450 (HUF 30,000 + VAT)/domain – gross amounts), from the 11th domain onwards a 100% discount is available, i.e. the procedural fee does not increase further.
The procedural fee will be handled by ADRF as deposit and reimbursed to the winning party at the end. ADRF will also send an invoice to the losing party.
The procedural fee shall be paid to the following account number at the same time as you submit your defence as to the merit of the complaint:
Beneficiary: Council of Internet Service Providers.
Bank account number: 10700299-70387423-51200002
Comment field: please enter the domain name(s) concerned by the complaint, which you will find in our email notification.
Please note that if you do not pay the procedural fee within 8 calendar days of the notification, all domain names concerned by the complaint will be deleted.
If a Party fails lodge its submission within the time limit, the Domain Decision Maker shall be entitled to decide on the case without waiting for the submission.
The language of the Procedures
The language of the Alternative Dispute Resolution Forum is Hungarian, and submissions to the proceedings by any party can only be made in Hungarian.
If an annex is in a foreign language, a simple translation must also be attached – failure to do so may result in the evidence being disregarded.
